Freelancers, independent software engineers, consultants, and artists in India often pay more tax than necessary due to a lack of awareness about presumptive taxation schemes and business expense claims.
1. Levering Section 44ADA Presumptive Taxation
Section 44ADA of the Income Tax Act is designed for specified professionals (software consultants, engineers, lawyers, doctors, accountants) whose gross receipts do not exceed ₹75 Lakhs (subject to digital receipt conditions). Under this scheme, you can declare 50% of your gross receipts as taxable income, immediately exempting the remaining 50% from income tax evaluation without keeping complex ledger accounts.
2. Claiming Business Expenses (If filing ITR-3)
If you prefer filing ITR-3 (non-presumptive) or do not qualify for Section 44ADA, you can deduct all expenses incurred directly to execute your freelancing services:
- Rent & Utilities: If you rent a workspace or home office, a portion of the rent, internet bills, and electricity can be declared as business expenses.
- Depreciation on Assets: Deduct depreciation on capital assets such as laptops, servers, office chairs, and air conditioners.
- Professional Subscriptions: Costs for SaaS software (GitHub, Slack, Zoom, Figma, accounting software) are fully deductible.
3. Section 80C & 80D Deductions
Don't forget individual deductions. Maximize Section 80C claims up to ₹1.5 Lakhs (PPF, ELSS, insurance) and Section 80D (health insurance premium up to ₹25,000 for self and ₹50,000 for parents).
